These Terms govern your use of NORM Rhythm, operated by NeuroSpire Labs, Inc., 5416 Alumni Drive NW, Huntsville, AL 35806 ("we," "us"). By using NORM Rhythm you agree to these Terms and our Privacy Policy.
NORM RHYTHM IS A COACHING AND SELF-GROWTH SERVICE. IT IS NOT A CRISIS SERVICE, IS NOT EMERGENCY CARE, AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL OR MENTAL-HEALTH TREATMENT. IF YOU ARE THINKING ABOUT SUICIDE OR SELF-HARM, OR IF YOU OR ANOTHER PERSON MAY BE IN DANGER, OR IF YOU HAVE A MEDICAL EMERGENCY, IMMEDIATELY CALL OR TEXT 988 OR CALL 911 (OR TEXT HOME TO 741741).
NORM Rhythm provides content and coaching for informational and educational purposes only. It is not a licensed medical or mental-health provider and does not provide medical or clinical advice, diagnosis, or treatment. No provider–patient relationship is created by your use. Where we connect you with a licensed therapist, that care is governed by a separate clinical agreement and Notice of Privacy Practices.
You must be at least 18 years old to use NORM Rhythm.
Clinical services delivered in person by a licensed clinician are separate from the Services and may be provided to a minor with the written consent of a parent or legal guardian and a signed intake. A minor may not hold a NORM Rhythm account.
Paid plans are sold via the app stores or our website and, where recurring, renew automatically unless cancelled before the next period; deleting the app does not cancel a store subscription. Refunds follow the applicable store or our stated policy.
Subscriptions. A full refund is available within 7 days of your first subscription payment. After 7 days, a subscription is refundable on a pro-rated basis only where the Services were unavailable for a sustained period attributable to us; a change of mind after 7 days is not a qualifying ground. Purchases made through an app store are additionally subject to that store's refund policy.
Rescheduling. A scheduled session may be rescheduled without charge with at least 24 hours' notice. With less than 24 hours' notice, or where the session is missed without notice, the session is treated as delivered and is not refundable.
Your use of NORM Rhythm must comply with United States federal law and the law of your state and local jurisdiction. Any illegal use will result in removal of the content and may result in deactivation of your account. No unlawful, harmful, harassing, or infringing activity; no scraping or reverse-engineering. You keep ownership of your content and grant us a limited license to operate the service; NORM Rhythm's models, assessments, and materials are owned by us or our licensors.
Provided "as is," without warranties. To the fullest extent permitted by law, NeuroSpire Labs, Inc. is not liable for indirect, incidental, consequential, or punitive damages; total liability will not exceed the greater of amounts you paid us in the prior 12 months or US $100.
You may stop using NORM Rhythm and delete your account at any time.
We may suspend or terminate your access at our sole discretion, for any reason, including but not limited to: (a) a material breach of these Terms; (b) non-payment; (c) violation of our policies, including the Acceptable use section above; (d) conduct that places another user, our staff, or the Services at risk; or (e) a requirement of law.
Where practicable and not prohibited, we will give notice. Termination does not entitle you to a refund except as set out in Fees, refunds & rescheduling, and does not relieve you of amounts already due.
These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law rules.
Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration seated in Huntsville, Madison County, Alabama, under the rules of the American Arbitration Association. You waive the right to bring or participate in any class, collective, or representative action.
Any matter not subject to arbitration — including an action to compel arbitration, to enforce an award, or to seek injunctive relief — shall be brought exclusively in the state or federal courts located in Madison County, Alabama, and you consent to the personal jurisdiction and venue of those courts.
This document is versioned. Minor corrections increment the decimal (for example 2.0 to 2.1); a material revision increments the whole number (2.0 to 3.0). The version in effect at the time an incident, claim, or dispute arises is the version that governs that matter, regardless of any later revision. Prior versions and their effective dates are retained and available on request.
We may update these Terms. Material changes will be communicated by email or in-app notification, and continued use after a change constitutes acceptance.
